    Greetings good people,

    I have a question in regards to my mother's situation. She has been with this company for over 27 years, she is 60 years old. In the past year or so, they started cutting down everyone's hours. Now she is to the point where she only works 2 or 3 days out the week, if that, when she is used to working 40+ hours. Just recently, there was a company meeting where the owners stated that depending on who wins the election, people will get laid off. What actions can she take and is there anything she can fight for or is entitled to for working with this company for so long. Thanks for your time. Any help will be greatly appreciated.

    I'm sorry to have to tell you this but, as an at-will employee, your mother can be terminated at any time for any reason not specifically prohibited by law. There is no law that prohibits an employer from laying off employees because they're not happy about the outcome of the election and, if they've been reducing everyone's hours in the past year, it sounds like the company is having financial difficulties that aren't getting better. Unfortunately, there's no law requiring severance pay. The only law that might come into play is the WARN Act (you can google it) which stipulates how much advance notice a company must give in the event of a large layoff or plant closure.

        Agree that your Mother could be laid off unless she has a binding employment contract to the contrary (example - employees there the shortest length of time get laid off first).

        You Mother might try applying for partial unemployment ins. due to the reduction in hours. Some states will pay UI due to a reduction in hours/reduction in pay.
