    Unless you are an arm or agency of the Federal, state or local government, that is entirely up to you. There are no laws in any state that require you to give any employee, any holiday off, and no laws that prohibit you from requiring the use of a vacation day. Even Massachusetts, which has the most employee protections of any state IMO when it comes to holidays, would not require you to allow the day off, paid or unpaid, or prohibit you from requiring that he use a vacation day. It's up to the employer.

    What are the laws concerning MLK Day. If a person asks to take the day off do I have to comply or will they have to use a vacation day.
