No, they are not. It's public record, though, but it may take a while for the records to be updated.

But are they required to notify their employees that they are in bankruptcy?

Since they are in a chapter 11 reorganization bankruptcy & you are getting paid & not owed any wages, there is nothing for you to do at this time. If you are concerned that they might end up having to close shop, you can look for other employment. It's hard to say how any individual co. will do after declaring a chapter 11 bk.

If they would close shop & you are owed wages, then action by you would probably have to be taken at that time. (ie file a claim for wages & hope they have the money/assets to pay you with)

    Chapter 11 bankruptcy..... Florida

Hi I just found out under the radar that my employer (a small business) has filed for chapter 11 bankruptcy. I was wondering if by law does he have to disclose to all of his employees that he has done so, and if so, since he has not and he filed it over 6 months ago what do you suggest we do as employees?

Normally do companies come out of chapter 11, and do we the employees have any rights if the business were to shut down or terminate operation all of the sudden without notice?

Any advice would be helpful. the business is a small independent cell phone provider with 3 stores and approx. 10 employees if that helps at all.
