    I have yet to receive W-2's from a few part time employers. I thought the Law stated that these had to be mailed by 1/30/09. Are these employers in violation? Can they be fined for this? This is holding up my refund!

    They have to be postmarked by today, 1/31/09. They're not in violation yet. The IRS will not even take a complaint until 2/15. And if your employer does get fined, the money will not be going to you, so relax.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      Furnishing Copies B, C, and 2 to employees. Furnish Copies B, C, and 2 of Form W-2 to your employees, generally, by February 2, 2009. You will meet the “furnish” requirement if the form is properly addressed and mailed on or before the due date.
