  • Is Co-Worker Pushing Her Luck?

    There is a co-worker who is collecting workmans comp and is working the
    7pm to 7am shift. Another co worker told her she can't do that and she has to work a 8-5 shift or she is a libilty to the facility.Is that true? This person is also not following company policy due to the smoking regulations at the facility, can she be fired for not following policy while she is on workmans comp?

    I'm confused. She's working AND collecting WC Benefits? At the same employer? Is she on light duty?

    If she IS working and violating the company policy on smoking (or anything else), yes she could be fired. Being on WC does not mean she does not have to following company policies.
