  • Exempt - Salary Florida docked hours

    I am an exempt salary employee for a Civil Engineering firm in Florida and recently have been informed that our office will be closed on Friday the day after the paid christmas holiday. I have been given a choice to either take vacation time or be docked the 8 hours and only paid for 32 hours that week. Is this legal in the State of Florida? What if a person does not have enough vacation time to take?

    Assuming that you are correctly classified as exempt, in all 50 states it is legal to require you to take vacation time for the day but in no state is it legal for you to be unpaid for the time.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
