  • used vacation - military move Florida

    Hello,
I had a baby in January and my company forces you to use your vacation time, even if not accrused yet. I had to turn in my resignation due to my husbands military orders and now they are requiring that I pay back my vacation time that they forced me to use on maternity leave that i have not yet accrued. Is this allowed since I am moving based on military orders?

    Thanks
    Meredith

Under USERRA, the military member is the only one affected by USERRA, not the dependents, so yes it is legal and allowed.

Yes, they in essence gave you a pay advance you did not earn. You can be asked to repay it.
I post with the full knowledge and support of my employer, though the opinions rendered are my own and not necessarily representative of their position. In other words, I'm a free agent.
