    Can a company deny a deaf person the right to operate a forklift based on safety concerns? Or is this considered discrimination?

    It depends on what the requirements of the job are and whether they can be reasonably accommodated by the employer. There is nothing inherent to driving a forklift that would preclude someone who is deaf from doing so. There may be other factors which disqualify someone however.
    I post with the full knowledge and support of my employer, though the opinions rendered are my own and not necessarily representative of their position. In other words, I'm a free agent.

      Having worked in manufacturing for many years where there were always forklifts in operation around the plants and distribution centers, this is a legitimate safety concern. I've seen more than one forklift accident avoided by another employee yelling "LOOK OUT!" I would have very serious safety concerns about having someone who is deaf driving a forklift. I think it can be credibly argued that the ability to hear is an essential function of the job.
