  • ADA Question Florida

Please advise if Sleep Apnea is covered under the ADA if so what must an employeer do to accommodate?

  • #2
The ONLY condition that is AUTOMATICALLY covered under the ADA is HIV/AIDS. ALL other conditions, without exception, have to be looked at on a case by case basis.

Whether or not any given individual with sleep apnea would be covered by the ADA would depend upon whether, IN THIS SPECIFIC INDIVIDUAL, the condition seriously limits a major life activity.

Assuming that it does, what, if anything, the employer has to do to accomodate is FAR too situation specific to answer on a message board. Particularly where we have no information whatsoever about the employee's position and what the essential functions are.
The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
