  • California wage claim for bonus?

    I'm working in a position that offers a monthly performance bonus pool in my department. The compensation plan that I accepted when I was hired specifically states that payouts will be by the 4th Friday of the following fiscal month.

    In my case, the 4th Friday of the fiscal month would have been 9/24/2010. I just received an email stating that I should receive the bonus payment on 10/1 (the 5th Friday of the fiscal month).

    My regular pay is unaffected.

    Can I file a wage claim for this discrepancy?

    This is really a contract issue, not a wage and hour issue. Besides, it's possible that the August fiscal month didn't end until Sept. 3 or something. Not likely, but not impossible.

    In any case, it's only a week delay and, IMHO, it's not worth making a big stink over. Sometimes you have to choose which battles to wage and which ones to cede.
