  • CA Labor Law: Separate Waiting Time Penalties... is this possible?

    CA Labor Law Question: When filing a wage claim, can a former employee file a waiting time penalty against a former employer for separate issues (ie. payroll wage penalty, vacation wage penalty, commission wage penalty) for the maximum 30 days allotted? Any help would be greatly appreciated.

    If I understand your question, the answer is no. You file one waiting time penalty request for ALL late wages at the same time. You cannot get separate waiting time penalties for each type of late wages. Past that, it is a request. CA-DLSE at the end of the day does not have to give anyone late time penalties.
