  • Can ER force EE to use accrued vacation time when EE iis Sick California

    California, private employer, hourly employee, employer has accrued vacation policy but no sick time accrual.
    Employee calls in sick for their 8 hour shift and employer uses 8 hours of accrued vacation, regardless of whether the employee wants to or not. Is this legal?

    Yes, an employer can decide when/how you use your vacation time. Vacation time doesn't even have to be offered by an employer.

      Agreed. I'd be grateful you have it to use.
      Not everything in America is actionable in a court of law. Please remember that attorneys are in business for profit, and they get paid regardless of whether or not you win or lose.

        Right, at least the OP gets paid for their time off. (unless they wanted to save it for an "actual vacation.") Anyway, what the employer did is legal.
