  • Unpaid Time off for Volunteering? California

    I was told recently that under CA Law all employers must give employees 40 hours per year of unpaid time off for community service/volunteering. However, I can not find anything to back up this claim?

    Has anyone ever heard of this? Can you point me in the right direction?

    I have never heard of such a law, no. We have a couple of CA experts; maybe one of them will have more information.

    You posted initially in the Disability Laws forum. Since your question has no relationship to disability laws, I have moved your question to a more appropriate forum.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

        News to me. I can give you a pointer to the CA legal code. Any chance the person who thinks this is an actual law can give you an actual legal reference?

          I happened to have the ca.gov website open doing some other research and it appears this is one of those "wishful thinking" laws that someone has made up. I can find NOTHING to support it.
          Not everything in America is actionable in a court of law. Please remember that attorneys are in business for profit, and they get paid regardless of whether or not you win or lose.

          I offer my knowledge and experience at no charge, I admit that I am NOT infallible, I am wrong sometimes, hopefully another responder will correct me if that is the case with the answer above, regardless, it is your responsibility to verify any and all information provided.

            Apparently no law as stated.

            The only laws close that I could find:
            Employers with 25 or more employees may not discharge or discriminate against employees that take up to 40 hrs. off each school year to participate in activities at their child's school. Employees must give reasonable notice and may either use existing vacation, personal leave, or compensatory time off or may take leave without pay. Ca. Lab. Code 230.8

            No employer may discriminate against an employee for taking time off to perform emergency duty as a volunteer firefighter, reserve peace officer, or emergency rescue personnel. Cal. Lab. Code 230.3
