  • California Computer and IT exemption

There is a common misconception that the salary/hourly pay must be met or exceeded among other criteria for IT and Computer employees to be exempt from overtime.

A careful reading of California labor code 515.5 indicates that this is not so, and that most IT personnel will actually be entitled to overtime pay since most do not meet the criteria of the statute. Talk to a labor attorney if you are unsure.
