    Many employees believe that they should attempt to approach management first with a claim of misclassification (exempt versus non exempt for overtime pay). While this may work for a small number of employees, we have found that taking this tact, while well intentioned may lead to retaliation, termination, constructive discharge, or suspicious layoff.

    We strongly advise employees that if they have a concern, voice it through their labor counsel, or at a minimum document the concern in writing to management and keep a copy. If the employee then experiences retaliation there is evidence.
