  • Update on Nevada casino employee Nevada

Hey, some of you might remember me. I was the pregnant employee that had difficulty qualifying for leave because I hadn't been there a full year. Well, I had the baby (he is wonderful and healthy and happy) but I went into labor a day early so I had to go back to work for after I gave birth.

I worked until my one year anniversary I've been calling in sick as though I have FMLA even though I couldn't get my FMLA approved. I meet the federal requirements for FMLA but my company won't approve me because "its not their policy." "I'm a part-time employee.) I had called and visited the human resources department several times, and finally one person told me my leave would be approved on the day of my one year anniversary. Well, again it was denied and since then I've left her messages but I haven't been able to get a hold of her. She isn't calling me back.

I've tried desperately to keep my job but they just don't want to give me anything. I think I'm going to get fired when I call in too many days. It's too soon for me to go back and leave my baby, so I'm going to stay home for a month or two and then look for another job. I'm also going to file a complaint with the labor board. I'm thinking that the labor board will recommend that the company reinstate me but I don't even know if I want to work for this company anymore. I just want the fact that they denied my maternity leave ON RECORD because apparently they've done this kind of thing to a number of people.

Any other advice? Oh, btw here is picture of baby.

If you now qualify for FMLA & they are not allowing you to take it, file
a complaint with the federal DOL as we suggested previously.

    Darling baby.

      Nevada casino employee- Final update!

Hi, I just wanted to let you all know that thanks in part to your help I kept my job!!! I met the requirements for FMLA but couldn't get human resources to approve it so I called in for every single shift for 10 weeks. I didn't want them to have any other reason to fire me (no call- no show, or accumulating too many points.) Anyway, I kept logs of all my calls to human resources with names of people I talked to and what they said, if they terminated me I was prepared to file a complaint. One day in August they sent me the paperwork and approved my maternity leave. Thank you to everyone who helped with advice. It means the world to me and my son. I'm so grateful I had a job to go back to. Just wanted to let y'all know, I appreciated your help.
