    Also keep in mind that FMLA is available only for serious health conditions, not for every day illnesses. If the baby had a cold, I can certainly understand that you'd want to stay home with him or her, but you could not use FMLA for that.

    If you mean is there any further leave time available to you under any laws once your FMLA is exhausted, the answer is no. You certainly can ask your employer for additional maternity leave time (to which they can say no.) If you want to be sure to have some leave time available in case you will need it to care for your child, then you'll have to go back to work earlier than 12 weeks.

    It's the employer's decision whether to allow any additional time off over the 12
    weeks of job protected FMLA.

    If you have a sick baby and are going to need additional time, bring it up to your employer now. By giving them the courtesy of notice, you give them time to see if they might willingly grant you additional leave and a chance to plan for your extended absence.

    That's entirely up to your employer. There is no additional guaranteed or protected leave.

    Im currently taking 12 weeks of fmla for pregnancy. 6 weeks paid, remainder unpaid.
    Due to go back to work in approximately 4 weeks.
    Is there any way to extend the leave (unpaid) or start another type of leave if the child is sick and requires me to be home longer?
