  • Sales Representative and Maternity Leave Michigan

    Manager just explained to me that while I am out on leave she will be passing out my client list to all of my teammates in order for them to look for new sales opportunity. Normally if I was not on leave other representatives are not allowed to prospect on your firms for new sales opportunities. She stated that they need to make sure that the client is followed up with while I am out. This I could understand, except that if I was not on leave I personally would not be required to follow up with my clients more often than every 90 days. If my client has been contacted within this 90 day period while I am on leave, how is the client not being taken care considering the rules already set in place for any other sales representative.

    Moreover, if all my clients are treated as new opportunity for existing sales representatives while I am away and sold product, what is left for me to come back to sale from leave. How am I going to be able to make my quota that is based on a database of clientele that has been amassed during a 2 year period.

    This seems unfair and like I am being penalized for having to take a medical leave. Can anyone help me to understand how this is legal. It seems like the basic rules are different if you are on medical leave.

    Will you be out on FMLA leave? How many employees does your employer have?

    If another employee took the same amount of leave under a "similar situation" but
    other than for pregnancy (example broken leg), would your employer do the same
