    Hello! I gave birth recently and was given 12 weeks of FMLA. When my baby was born he needed surgery and currently has medical needs. At this time, I am on my 11th week of my leave. I asked for an extension of the leave because my son can only be home with a medical professional or with a trained trach care person (ie my husband or myself). I requested an extension until my husband is on summer break and will be able to stay at home with the baby. Unfortunately I was denied, and told that a week extension was the company policy otherwise I had to resign. At this point, I am leaning towards resignation but was hoping that I could collect unemployment. Does anyone know if this is possible considering that I am resigning? Also I work at one of the casinos (didn't know if that would make a difference in terms of labor laws). Thanks in advance!

    Under the Connecticut Family & Medical Leave Act, employers with 75 or more employees must allow eligible employees up to **16 weeks of unpaid leave in any two-year period** in the event of the birth or adoption of a child, serious illness of the employee, or serious illness of a child, spouse or parent (including parent-in-law).

    Eligible employees are those who have been employed for 12 months or more (need not be consecutive) for a covered employer, and who have worked 1,000 or more hours in the 12-month period preceding the first day of leave.

    Employers subject to both the state and federal family and medical leave laws must provide the benefits most generous to the employee under both statutes.

    Would the above apply to you - does your employer have 75 or more employees?

    Ct. says this re UI: If you QUIT your job, the purpose of the hearing is to give you an opportunity to establish that you had good cause attributable to the employer for quitting the job. There are very few non-job-related reasons for quitting under which you may be approved for benefits. These include quitting to care for a spouse, child, or parent with an illness or disability, and quitting because of a loss of transportation other than your own personally-owned vehicle, provided you are otherwise eligible. Keep in mind that you do have to be able and available for full-time work in order to be eligible for unemployment benefits.

      Hi Betty, Thank you for your reply! Yes it is a very big company (way over 75 employees) but I didn't know if they had different laws because it is a casino and under tribal nation.
      I am in fact able to work - I just needed the extension of 4-6 weeks in addition to the 12 weeks that I had but they would not grant it to me.

        Oh Gee, I don't know. Maybe someone else will come along & know. If not, you can contact the Ct. DOL & ask. They oversee the Ct leave law.
