  • NJ Maternity leave - obligations of an employer New Jersey

    I have a small company with 9 employees. One of my employees went on Disability/Maternity leave in March.. She was not 100% sure if she was going to come back to work, she said she may come back part/time but wasn't 100 % sure.. I dont hear from her until today, over 4 months later and she is asking about her job... and that she may want to start back in September or October. Am I under any obligation of having to hire her back?

    No. Even if FMLA or NJFLA applied (doesn't due to you not having enough employees), you are only required to hold the job open for 12 weeks. You're free to handle this as you wish & may terminate the employee.
