  • NY: For how long can you collect back pay

    Hello. I live in New York. In approx. 1996 my dad's employer did not pay him. We are talking about almost $13,000. He filed a claim with the NY Labor department and a criminal warrant was issued for his employer in 1997. His employer left the country after the warrant was issued and i believe he came back now. I would like to know if there is a statute of limitations on collecting the back pay and is the warrant still valid. I would really like to get this money back. Also can i get interest? Thank you for any info you may have.

    You should go back to the authorities you contacted previously and give them any and all information that you have that makes you think that the employer in question is back in-country.
