  • Vacation pay in Florida

    The employer i worked for in Florida just fired me last week. My question is does he have to pay me the vacation hours I have earned and not taken for this year????

    Did your employer have a policy regarding the pay out of vacation at termination?
    I post with the full knowledge and support of my employer, though the opinions rendered are my own and not necessarily representative of their position. In other words, I'm a free agent.

      And even if your employer has such a policy, if they refuse to follow it, you would have to sue, as the Florida Dept. of Workforce Innovation only enforces laws, not private agreements or implied contracts.

        The bottom line answer to your question is that Florida has no laws requiring the payout of vacation time at termination.
        The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
