    Vacation pay put in before notice

    I had 3 days vacation pay. I used 2 days and then a few days later I put in my 2 week notice. After I have recieved my check with my 2 days vacation pay our payroll person came up to me upset because she said she was told I should have not gotten them and she was going to pay it back out of her pocket. I said no. My boss said that I should have not had vacation pay on my check but last year I had it and this year I had it. Is that fair? I told her (out payroll lady) to cut me a new check because I didn't want her to pay for it. If I had it on my check and put in my 2 days vacation before I quit, can it be taken away?
