  • Termination of salaried employee

Arizona Labor Law regarding termination of a salaried employee. The employee was terminated 2/6/06 and had put in 53 hours in the payperiod; would he be paid for the 80 hours salaried or only paid for the 53 hours worked?

  • #2
Only for the 53 worked. There are a few exceptions to the law that says an exempt employee must be paid their entire salary for every week in which they work, and the first and last weeks of employment, if the entire week is not worked, are among those exceptions.

The employer may choose to pay the entire week but is not required to do so by law.
The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
