    I have a friend who was recently terminated, employer has not paid him his final paycheck it has been 2 weeks we filled out wage claim form and have received notice from former employer stating he owes company money and that position was commission although position paid a base pay plus commission, letter also stated he cannot work in this field within 120 mile radius is this legal?

    A noncompete agreement is only valid if agreed to. Regarding the final pay, are they saying they are not going to pay it because he owes the company money or property? Does he?

      Non-compete agreements

      Texas courts have generally been pretty employer friendly about non-compete agreements, especially in the tech and semi-conductor industries. However, there has sometimes been a line drawn when the employer has terminated, and the employee is essentially deprived of livelihood.

      You'd want to talk with an attorney about the enforceability of the non-compete agreement. These are very industry, and jurisdiction, specific. Also has a lot to do with how well it's written.
