    I have a question. We have someone working at our office in NY for a computer consulting form for the past 10 years. He gave us notice that he will be leaving us at the end of July. My question is, if I was to give him 2 weeks notice instead of to the end of July, and within those 2 weeks he is taking some vacation days. Can he turn around and say that he is not taking his vacation that he wants to get paid for it?

    Also, is he entiled to his vacation pay? He did quit first but if I want to have him leave early what is he entiled to?

    You do not need to pay him any vacation he has accrued and not used. If you want him to leave earlier, you do not need to pay him for that time. However, just a caution - other employees are watching the situation. If they get the idea that you do not let people work / or get paid for the time past the notice, they may feel that they do not want to give you notice at all. This could be detrimental to you in the long run.
