    I Live In Maryland And Want To Take Care Of My Unborn Neice Once Born. If The Mother And I Get A Notorized Letter Giving Custody To Me, Will This Child Qualify As A Dependent For Me To Use The Fmla???

    No. Your PM to me indicates that your employer does not have the requisite number of employees for FMLA to apply, so the documentation is immaterial.

    It will be up to your employer to determine how much leave you are entitled to and what documents they want to see.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
