  • Freelancer laws NY

I am a freelance word processor with a large firm in nyc. I have worked here for 30 years (12 full time; 18 freelance). I'm curious as to exactly what the laws are for freelancers as my company is suddenly capping our working hours. Although freelance, I have 30 scheduled hours per week. Is it true that I cannot work any more than that? Occasionally I need some extra money as well as the company needing extra help. Is it also true that I MUST take a lunch break of 30 minutes? I would prefer to leave early rather than lose 1/2 hour in pay. Please tell me what the laws are or where I can find out more. Thanks

By freelance, do you mean you are an independent contractor (1099) or an employee with no set hours? If it is the latter, they can cap your hours and they can make you take your lunch when they choose.

For information on the difference between Indepenent Contractors and Employees, check out: http://www.dol.gov/esa/regs/compliance/whd/whdfs13.htm
