  • IL and CA health/dental insurance laws

    I live in Illinois and work for a company that is based in CA. Every full-time employee in CA (also WA) is offered 100% employer paid dental insurance. Full time IL employees were told this same dental insurance will not be offered to us because it is too expensive in IL (no dental insurance is available, regardless of the employer coverage). Is it legal for companies to offer some employees insurance, while not offering others at the same employment level the same insurance, even if they are working in a different state?

    Yes it is. In fact, it is not uncommon at all for companies with employees in different areas of the country to offer different benefits exactly for the reason your employer has stated; also because similar benefits just may not be available in the area. In order for this to have a possibility of being illegal discrimination, it would have to be based solely on a protected characteristic, such as age, race, gender, national origin, etc.
