    No. You are not under the control of the employer because you haven't reported to work yet. This is no different than commuting on a regularly scheduled day. You are fortunate they are even paying for drive time as, in most situations, that is not required by law.

    I am a California full time employee My employer requires me to be on call one week in three. If I get called in to work , I will be paid for the drive time from home to my place of work. They guarantee a minimum of two hours pay for the call in, Am I entitled to mileage for these call ins since I am under control of my employer during this time?.
