  • NY Labor Law Questions

    I was wondering if someone can give me some information about NY Labor Laws. I work in a Service Coordination office for people with developmental disabilities. One of these person has been working for McDonals for the las 20 years, not reciving time off, sick, vacation benefits and his actual wage is 7 dolars.

    Is there any legal wage raise?
    what happen with these benefitis that he hasn't gotten?

    I would appreciate any information about

    Is there any legal wage raise? Only if an individual is earning minimum wage and that is increased by an act of the State legislature or the federal government.

    what happen with these benefitis that he hasn't gotten? Maybe nothing. Employers aren't obligated to provide benefits to employees and in many cases employers provide benefits selectively, for example, only to full-time employees and not to part-time employees.

    Since we don't know how your client's employer "classifies" this employee and what their policies are regarding eligibility for benefits, it's impossible to say whether the employer has broken any laws.
