  • FIRED What are my rights

    I was fired from my job while out on a doctors note for not forwarding a Personal Improvement Plan form back to my job. I couldnt because I was out. I talked to them while on leave and I said I would try to get it in the mail. I wasn't feeling well and never got it in the mail. They called me on friday at 1:30 told me I had until 3:30 to deliver it to them or I was terminated. I got the call this morning that I was terminated and my final check was mailed to me on Saturday. Do I have any rights?

    You have the right to apply for unemployment benefits and look for a new job.

    Am I correct in assuming that the requirement that you forward the completed PIP to them by a certain date didn't just come up while you were out sick but rather that you'd been given some time to complete it and procrastinated until you were SOL?

      Yes, you have the right to file for unemployment and to look for a new job.

      If you are asking whether your employer violated any laws in terming you, they did not. The fact that you had a doctor's note for the absence does not mean that you cannot be fired.
      The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
