    I recently moved to CA and got a job working at a non-profit. I am a salaried employee working 40 hours a week. I read in our employee manual that vacation time is not given at all until you have been at the company for a year. I thought this sounded unlawful since in 10 years in the working force I have never encountered a company that does not allow any vacation days for a year. My biggest concern is that my family lives in one state, my husbands in another and we live in yet a third state. Not having a vacation day will make visiting family on the holidays tough since christmas falls on a saturday!

    If, after a year, you have the vacation to take, then that policy is a subterfuge according to California law. The law would consider that you had, in fact, earned this vacation throughout the first year. This example is specifically mentioned here:

    However, the policy can legally state that you cannot TAKE vacation in the first year, even though you are earning it during that period.
