    Is it legal to deduct salary employees paychecks for taking a sick day? We do not get comp or overtime benefits..Thanks in advance

    Salary is only a pay method and has no legal standing. If your position qualifies for exempt status under the Fair Labor Standards Act, then your paycheck may be docked if (a) you have exhausted any reasonable paid sick days benefit your employer provides each year and (b) you are again absent due to illness for a full day. Exempt employees need never be provided comp time or paid for any overtime.

    If your position is non-exempt, then you need only be paid for the hours you actually work but you must also be paid for any overtime you work.

      ok..we follow a hourly handbook. So I'm assuming we are nonexempt. It that case we can get our paychecked docked for sick leave, however, we should get paid for overtime right? Thanks
