  • IS it Legal in CA

My husband was hired as a mecahanic at one of our local dealerships. He has been there for 18 months on hourly rate.
They came to him 2 weeks ago and told him they were putting him on flat rate. Basically how that works is:the book says it takes .30 hours to do brakes on X car. If it takes him .30 hours great...if it takes him .45 hours or longer he still only gets paid for .30.
Essentially this is a pay cut for him.
    Is this legal???

    Thanks

    Kathy

Yes, it is, and it is the standard in the industry for mechanics. As long as he is paid the equivalent of at least minimum wage, there is no wage and hour violation.

Or, it could be a "raise". If he finishes the job in 15 minutes, he still gets the flat rate for the job that was based on it taking 30 minutes.
I don't respond to Private Messages unless the moderator specifically refers you to me for that purpose. Thank you.
