    I am a waitress at a local franchise restaurant (Ponderosa) and corporate has made a new rule, but I'm not sure if it's legal. In the past, waitresses have been allowed to leave whenever they get their cleaning done and their stations have been checked. When I returned from vacation, there is a new rule saying that everyone has to wait until everyone else is done to leave..even if I get done cleaning at 10:30 I have to wait until 12:30, whenever until everyone's ready to leave. We do not get paid for sitting and waiting either. So my question is, how can we be made to stay at work and not get paid for it? Is there a law that specifically talks about this? Also, my general manager's wife is a waitress there. The general manager makes the schedule and sometimes his wife gets an entire week off without even having to work. He basically lets her work, puts her on the schedule whenever they need the extra money. Is there a law saying this is illegal? And, waitresses that work here are only allowed to request off two days a month...and his wife gets a week off at a time or whatever. Thanks.

    If you are required to stay at work, even though you are not actually working, you must be paid for that time. That is because you are under the employer's control, cannot leave the premises, and you are "waiting to be engaged". Contact your state Dept. of Labor to file a claim for unpaid wages.

    The rest of that is not illegal. Maybe unfair, but not illegal.
