    Can caregivers in a day care be considered contract labor?
    We would like to give a 1099 statement of earnings only.

    Very likely not. If you have control over when and how the worker does his job, and provide the tools with which to do it, you have an employee, at least according to the IRS. See here:

    Be very careful here. You could end up owing a lot more to just the IRS, not counting the state, than just the employer taxes you will "save" by treating your employees as ICs when they are not.
