    hi. i'm a grad student in pennsylvania. along with teaching at two colleges and writing a dissertation, i work at a family-run natural food store. my mother is a salaried employee there. the store is owned by a woman in her 70's and her son, a 44 year old alcoholic is my manager....he manages me and one other employee. he is a confirmed alcoholic. been in rehab. he drinks both beer and alcohol-based herbal tinctures at work until he is drunk. i mean DRUNK. his mother refuses to do anything and he can become, well, MEAN. is it legal for her to 'permit' him to drink at work? is there any law out there which would protect us from being fired if we complained? is there ground for threatening a lawsuit? what can we do?

        jehh, the answers to your questions are yes, no and no. Allowing an employee to be drunk at work is a foolish, foolish thing to do, but no laws prohibit it.
        The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

          nothing illegal in being drunk

          so no problem, until he gets behind the wheel. but, is stupid, stupid, stupid by employe, and porbbaly only is allowed since it is the son of the owner.

            Ha ha Patty. Not a joke. It depends on what the dissertation is, I feel. Is it on health foods, dietary stuff, or the socil impact of alcoholics in the workplace?

            I've seen similar stuff before, student has a paper to write, they don't get it done in time, so they pop a post here or elsewhere hoping someone would give them the answer.

            If it's not a student thing and is a real issue, then I'd say quit. I've worked with alcoholics and I wouldn't wish that on anyone. Even if you think a person is predictable, think again. Booze changes all of that.
