    Hi

    I am in desperate need for help . I am a hourly employee on a H1B visa. I was offered work through a Company X, and i took the contract. Since there is a company Y which holds my Visa,the pay arrangement is like this:

    Company X pays company Y, for the hours I worked and in-turn i get my paycheck through Y. That is, Y has signed an Agreement with X on my behalf, that X has to pay within 30 days of invoicing. But since the last 4 months(Starting Jan 15th) X is not paying Y, and so i am not getting any pay. I have spoke to the ppl at X, and each time they have some or other kind of excuse.

    My question is can I take legal action against Company X directly instead of Y as Y is not at all agressive in collections and is reluctant about spending money on legal issues.

    Taking Action

    No, but you can pursue Company Y, assuming that you are an employee of Company Y, which it appears that you are. What state are you in?
