  • Share Employe Records?

    I am in California and have a client who would like to have copies of 5 of our employees Employment Verification forms. There was a question of 2 of them being illegal. The employees work for us but are assigned to the clients clinics. Can I shared this information without violating the employees right to privacy?

    Legally, yes, you can, but that doesn't mean it would be wise to do so. With indentity theft as rampant as it is, I do not believe anyone without a verifiable need to know should be given access to anyone's records.

    Assuming that this is correct, if I were in your shoes I would tell the client that your employee's records have been investigated and you have confirmed that they are legal; however, your employee records are company property and will not be shared.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
