    I am a West Virginia business owner. I understand that if you have an employee on salary and that salary must be at least 455.00 per week and equal at least $23,660.00 per year. My question is what if I have an employee that makes $300.00 per week salary and made $40,000 in commissions for the year, does their salary still have to be at least 455.00 per week?

    Great question. Unfortunately, the salary portion must be a true salary, not subject to changes in quantity or quality of the employee's work. Information may be found at: http://www.dol.gov/esa/regs/complian...17g_salary.htm

    Are your employees outside salespersons? The salary requirement does not apply to outside salespersons.
