I currently live in California and my husband and I work for a company that pays commission only(1099).. My husband is the Manager for a district and we had a 5 year lease in our office. About 8 month ago his manager force him to defoult on his lease and move in to his office in a different city. His manager also requires him to be there working most of the time. My husband has to pay rent for his office. Remember my husband is a 1099 Independent contractors not employees. His manager checks his voicemail and he has no privacy. Is this legal? or can you tell me what the definition of independent Contractor is?

Independent Contractor
An independent contractor is usually required to cover their own expenses, etc. The checking of voicemail is strange but it does not necessarily negate the independent contractor status. You can read more about independent contractor status at: http://www.dol.gov/esa/regs/compliance/whd/whdfs13.htm
