  • PERB - Successorship Clause California

    I'm having trouble determining how PERB would rule on representation issues where one public agency acquires another public agency.

    The seller have successorship clauses in their CBAs stating that the employer must make recognition of the bargaining unit a condition of sale.

    Is the purchaser required to recognize the unions even if the seller does not make it a condition of the sale?

    This is way beyond what can be answered on a message board. You will need to have a lawyer review the contracts and sale documetns to get an answer.
