  • Not getting paid for hours that I have ALREADY WORKED! Maine

    So, I have been noticing discrepancies in that hours that I have worked and the hours that I am getting paid for, so I said some thing to one of my managers and she told me that she was already aware of the situation. She went on to tell me that one of the other managers was caught changing employee's hours in the computer, to bring down her labor. So now another pay period comes around and the discrepancies are still there! It is not my fault that their labor is high. I feel that this is illegal, but the mangers at my job keep blowing it off when I bring it up It seems as though doing this (not paying employee's for the full amount of time they had worked) is becoming standard practice now. Please someone let me know what I should do?

    Start documenting actual hours worked at home. File a wage claim with state DOL.

      The thing about all of this is that I have store tickets from the register from when I clock in and out. They aren't saying that it isn't happening they just seem to not care! When I try to talk to a manager about it I get the impression that if I make an issue about it I will lose my job!!!

        Keep track of your hrs. & file a wage claim as suggested. It's illegal to terminate
        you for filing a wage claim with state DOL. If they do, you do have recourse you can take.

          If you want a second choice, start documenting all hours worked and not paid (keep the documentation at home), start looking for another job, and file the wage claim on your way out the door when termination becomes an idle threat.

          At some point a bad employer is a bad employer. If the employer is doing this to you now, they will be doing something worse in the future. I am fine with filing claims, but at some point, any good solution involves being somewhere else.

          While I am in agreement with Betty on the wrongful termination claim, the results are not automatic. You will claim that you were terminated because of the unpaid wage claim. The employer will claim some unrelated reason. If they lose, they will likely appeal. Maybe you will win, maybe you will not. It is always worth while filing the claim, but the key problem is that your employer is a bad employer. Winning the claim(s) will not change that. Changing employers might.

            It's a choice you have to make. You can file a wage claim now or file after employment with this employer is over.
