  • My former employer is holding my paycheck - AZ Alaska Arizona

    I quit my job about a month ago and my former employer is holding my paycheck for missing receipts. Can they do this? I'm pretty sure that I wasn't missing any receipts but, I know I'm not missing the number of receipts they say I am. Either way it seems like they can check the purchases with the credit card company. Right? Help! What do I do? It's enough money to need it but, not enough to hire a lawyer.

    You can try filing a wage claim with your state's DOL. It's free.

    PS You had more than one state in your title - I see you edited it to Az. - Your DOL would be Industrial Commission Az. However, they do not handle wage claims over $2,500 - if over that amt., you can file the claim with the federal DOL. Small claims court's in Az. only consider amts. up to $2,500 also.

      I might add that in Az. when employees resign, wages should be paid in the usual manner no later than the regular payday for the period during which the resignation occurred. If resigning employees want to receive the check in the mail, employers must mail them.

        The only state that gives an employer permission to hold a paycheck hostage to property not returned is South Dakota. So I would agree with Betty's suggestions.
        The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
