    The company I work for owe a staffing agency for a temp that worked for us for a few months. We are very late on the invoices as we are barely making payroll. The staffing agency is threatening to go to the Labor Board. Wouldn't they have to go to small claims instead since they were a contractor? The temp that worked was already paid by the staffing agency.

    Yes, it's likely that they will have to go through small claims court.

    Do you really think it matters? Either way, you still owe them money.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      You are not in violation of any DLSE regulation. The "Labor Board" regulates the employee-employer relationship; you are neither. I wouldn't worry about it.
