  • Severance Requirements California

My company has a current and state severance policy that has been in place for several years, and unfortunatley due to several RIF's over the last 12 months, fairly active. I'm assuming since this is policy that company should continue to pay severance for the next pending RIF (a few weeks off) as the practice would be contractual? I would appriecaite any commentary/input as it relates to recommendations for continued adherence, risks for non payment etc.

Whether the policy rises to the level of an enforceable contractual obligation, only an attorney versed in employment/contract law in your state could advise you adequately, after reading the document in its entirety.

Past practice in and of itself does not generally create a contract.
