  • Mandatory Use of Paid Leave

    My company does not offer sick leave and currently allows hourly employees to choose whether they want to use their paid leave (ie, vacation) when they're out sick or take the time unpaid. This has led to some problems with a few folks abusing this privilege by taking enough time off that, at times, it has hindered our operations.

    Is anybody aware of any states that prohibit an employer from requiring employees to use any available paid leave when out sick? The specific states I'm interested in are Idaho, New Mexico, Colorado, Kansas, Texas, Arkansas, Florida and North Carolina.

    There is no law in any state that prohibits the employer from requiring the use of any paid leave when out sick.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
