  • Payroll clerk adjusting time cards per boss Maryland

    I work for a small company in MD that has recently implemented a 30 minute mandatory lunch break. The payroll clerk is manually adjusting time cards to reflect a 30 minute lunch everyday for every employee. Regardless of whether a lunch is taken or not. I have told her that this is illegal and against FLSA laws. She is also deducting hours that an employee is here before or after their scheduled shift. Once again stating that she is only doing as she is instructed. My question; if I call the labor bored will she be "at fault" or just the company? I do not want her to get in any legal trouble. But I am tired of my hours being deducted. I am here, I am working and deserve to be paid. Who gets in trouble?

    The company will get in trouble with the state. But that doesn't mean that the employee will not get in trouble with the company.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
