    ok my boss is leaving for vacation but our pay day falls on that days that he will be gone does he have to pay us b4 he leaves its a small office he does payroll

    Are you non-exempt employees? If so: 204. (a) All wages, other than those mentioned in Section 201,
    201.3, 202, 204.1, or 204.2, earned by any person in any employment
    are due and payable twice during each calendar month, **on days
    designated in advance by the employer as the regular paydays.**
    207. Every employer shall keep posted conspicuously at the place of work, if practicable, or otherwise where it can be seen as employees come or go to their places of work, or at the office or nearest agency for payment kept by the employer, a notice specifying the regular pay days and the time and place of payment, in accordance with this article.

      What makes you think that he won't make arrangements for you to get your checks on payday? Did he tell you this?

        Just a thought but does the employer offer direct deposit? If so, and you sign up, then these sort of problems go away.

          He does not have to pay you before you leave. He only had to make sure you get paid on your normal pay day.

            well

            he is leaving out of state the 5 are pay day is the 11 he wont be back till the 16
            and he is only one in office to do checks

              Have you spoken to him about this? Do you KNOW that he doesn't have a backup?
